In accordance with Article 10 of the LSSI-CE, this information is kept permanently, easily, directly and free of charge accessible to users.

2. Purpose and scope

This Legal Notice governs access to, browsing of, and use of the application and website myplacenet.app (hereinafter, “Placenet” or the “Platform”), a service that allows users to connect with people, events and activities located in their real-time geographical proximity, through chat functionality, the posting of listings, and the creation of or participation in plans.

Access to or mere use of the Platform by any person confers the status of User, which implies full, express and unreserved acceptance of all conditions included in this Legal Notice, in the Terms and Conditions of use, and in the Privacy Policy and Cookie Policy.

3. Access conditions and minimum age

Use of Placenet is reserved for persons over 14 years of age. Users between 14 and 18 years of age must have the consent of their parent or legal guardian for the processing of their personal data, as required by data protection legislation applicable to minors.

Placenet reserves the right to request verification of a User’s age and to suspend or delete any account it becomes aware of as belonging to a person under 14 years of age.

4. Use of the Platform and User liability

The User undertakes to make diligent, correct and lawful use of the Platform, and shall refrain from:

  • Impersonating other users or using false profiles.
  • Posting content, listings or messages that are unlawful, defamatory, violent, sexual, discriminatory, or that infringe the rights of third parties.
  • Using the geolocation or chat functionality to harass, intimidate, or put other users in contact without their consent.
  • Introducing viruses, malware, or any code capable of damaging Placenet’s technical infrastructure.
  • Making unauthorised commercial use of the Platform or of content generated by other users.

Failure to comply with these obligations may result in the suspension or cancellation of the User’s account, without prejudice to any legal action that may apply.

5. User-generated content and moderation

Placenet acts as an information society service provider that hosts content generated by users themselves (listings, messages, profiles, events). In accordance with Article 16 of the LSSI-CE, Placenet shall not be liable for such content unless it has actual knowledge of its unlawfulness and fails to act diligently to remove it or block access to it.

Placenet provides users with a channel to report inappropriate content or profiles, and reserves the right to remove content, and to suspend or delete user accounts that breach these terms.

6. Intellectual and industrial property

All content on the Platform (texts, design, logos, source code, the “Placenet” brand and other elements), excluding content generated by users, is owned by Placenet Internet of Places, S.L. or by third parties who have legitimately authorised its use, and is protected under applicable intellectual and industrial property law. Its reproduction, distribution or commercial exploitation without the express written authorisation of the owner is prohibited.

7. Disclaimer of warranties and liability

Placenet has adopted reasonable technological measures to ensure the availability of the Platform, in accordance with Article 16 of the LSSI-CE. However, it shall not be held liable for:

  • Technical interruptions or lack of availability beyond its control.
  • The content, accuracy, or conduct of users interacting through the Platform, including meetings or gatherings arranged between users outside the app.
  • Damage arising from improper use of the geolocation or chat functionality.

The User acknowledges that any physical interaction or meeting with other users takes place at their own risk and discretion.

8. Links to third parties

The Platform may include links to third-party websites. In accordance with Article 17 of the LSSI-CE, Placenet exercises no control over such sites and assumes no liability for their content, unless it had actual knowledge of its unlawfulness and failed to act diligently to remove the link.

9. Data protection and cookies

The processing of users’ personal data, including geolocation data, is carried out in accordance with the General Data Protection Regulation (GDPR) and Organic Law 3/2018 (LOPDGDD). For more information, please refer to our Privacy Policy and our Cookie Policy.

10. Amendments

Placenet reserves the right to modify this Legal Notice at any time to adapt it to legislative developments or changes in the Platform’s activity. Amendments will be considered effective from the moment they are published.

11. Applicable law and jurisdiction

The relationship between Placenet Internet of Places, S.L. and the User shall be governed by applicable Spanish law, in particular the LSSI-CE. For the resolution of any dispute, both parties submit, expressly waiving any other jurisdiction, to the courts of Barcelona, unless applicable consumer protection legislation mandatorily determines a different jurisdiction.
